(Doe verses Covington County) is a case where the school allowed a stranger to check a nine year old out, then raped and sodomized her on six different occasions. The parents filed suit and the federal judge dismissed it, because the school is not recognized as a custodial special relationship. Untouchables.Basically Admin cannot be held liable for failing to protect students. Parents are expected to protect them when they are not present. It's a twisted corrupt setup. Administration can only be liable if they directly harm assault/molest the student themselves. The student code of conduct or any part of school policy they fail to enforce, No one can hold them accountable for. They are self governed and the (most) white-wash the extreme school violence issues.http://www.ca5.uscourts.gov/opinions/pub/09/09-60406-CV2.wpd.pdfIn Doe verse Covington ("The court concluded that under the Supreme Court’s decision in DeShaney v. Winnebago County Department of Social Services, 489 U.S. 189 (1989), Jane had no constitutional right to be protected from harm inflicted by a private actor suchas Keyes except under one of two narrow exceptions—the “state-created danger”theory and the “special relationship” exception.")("A panel of this court reversed in part, concluding thatthe student had a special relationship with her school under DeShaney v.Winnebago County Department of Social Services, 489 U.S. 189 (1989), and that the school was therefore constitutionally obligated to protect her from acts of private violence."); ( !!! ("The panel nevertheless granted qualified immunity to those defendants sued in their individual capacities.")Private schools can be held liable for (negligent care of a minor) because they are not government protected = sovereign. Not one case has made it to jury, yet. Settlements are made out of court with gag orders to keep the schools appearance.www.schoolbusters.org
Stop Bullying/Violence/School Abuse WHERE ARE THEIR RIGHTS TO PROTECTION? Schools are NOT enforcing student code of conduct policy. They want to keep the violent bully headcount money.

So proud of you, Michelle. I told you quite some time ago to take it to the news. This is the only way to make parents aware that this has gotten so serious. We had one or two bullies in my younger days, but not like today. We place our children in the school's care and we as parents should know and feel our children are in a safe learning environment. I realize there are children at school that are disruptive and I suppose sometimes hard for faculty to handle.
I know for a fact Johnny Spur is NOT one of those disruptive children. I've been around him for years and he is a great child with manners and respect for others. I am so glad he is liking his new school. I feel so much compassion for bullied and abused children. As you know from experience, it affects them for a lifetime!
Why wont schools report?
To provide a clean safety data report to keep their jobs. There is no way schools will ever make true reports and make themselves look negligent. Why do parents tax dollars pay Texas Education Agency Attorneys to defend the school against the STUDENT? What attorney can parents call for help against the powerful umbrella of sovereign immunity the school is under?
